The firm’s practice includes all aspects of estate planning from simple to complex estates, including:

  • The preparation of Wills, trust agreements, and powers of attorney
  • all facets of charitable giving including the preparation of charitable lead and remainder trusts and the creation of private foundations
  • family giving techniques including the use of irrevocable trusts, private annuities, and promissory notes
  • specialized planning for family businesses including the creation of family limited partnerships and limited liability companies

The firm also advises with respect to all related tax matters including the application of income, estate, gift and generation-skipping taxes. The firm prepares estate and gift tax returns and advises with respect to the preparation of fiduciary income tax returns.

For clients who use the firm for their estate planning or probate matters, the firm will also assist with Title 14 guardianship and conservatorship matters, including the appointment of guardians and conservators and advice on the administration of the ward’s estate.

While the firm advises with respect to domestic asset protection; the firm does not handle off shore asset protection planning.

The firm handles post-mortem administration matters, including probate proceedings, advising with respect to the administration of trusts and estates, and the preparation of estate tax returns.

Finally, both Roger Curley and Kiernan Curley have extensive experience with respect to probate and trust litigation matters. Roger Curley worked as in-house counsel for the trust and financial services department of First Interstate Bank of Arizona and has considerable knowledge of the particular issues confronting corporate fiduciaries.

Roger D. Curley

Partner

Roger D. Curley is a partner practicing in the area of estate planning, probate, and trust law. Prior to returning to private practice in 1992, he had been trust counsel for First Interstate Bank of Arizona, N.A. for seven years where his principal job responsibility was to advise the bank’s Trust and Financial Services Group on legal matters involving probate and other fiduciary accounts. Before and after working at First Interstate, Mr. Curley was in private practice concentrating in estate planning, probate, trusts, and taxation. He received his A.B., magna cum laude, from Dartmouth College in 1972, his J.D. in 1975 and LL.M. in taxation in 1982 from New York University. He is admitted to practice in Arizona, New York and Wisconsin. Mr. Curley is a member of the American, Arizona State and Maricopa County Bar Associations. Mr. Curley has presented numerous seminars on estate planning topics.

Kiernan Curley

Partner

Kiernan Curley works with estate planning documents (Wills, Revocable Trusts, Health care powers of attorney, durable powers of attorney and living wills). He is also involved in post-death adminstration and litigation including petitions, objections, basic discovery, drafting appellate opening, response and reply briefs and appearances in the Maricopa County Superior Court.
